Myopic person can’t be denied job, rules HC

New Delhi:  The Delhi High Court on Thursday ruled that a person suffering from myopia (shortsightedness) cannot be denied a job with the Indian Administrative Service (IAS) if he or she is qualified on merit.  The order came on a two-year-old petition filed by Ravi Kumar Arora who was not allowed to join the IAS in 2002 on account of poor vision.

Justice Sanjay Kishan Kaul was critical of the second reason that the government had given for not appointing Arora.  While rejecting his application that he be considered under the disabled category, the government had said that such posts had not been identified till then.

Kaul said: “The process of the government to ‘once again identify’ the posts, which it failed to do despite eight years having elapsed cannot be awaited for the petitioner to be appointed to the post.”  After Thursday’s order, Arora has to be appointed in category A of services.  The government will also have to give him the seniority, which his batchmates enjoy.
